And In Re : Sahil Aktar ...... petitioner Mr. Anisur Rahaman ....for the petitioner Ms. Faria Hossain Ms. Baisali Basu Ms. Mamata Jana ....for the State One person died due to an accident caused by a speeding motor cycle driven by the petitioner. The other suffered grievous hurt.

The injured in his statement stated that, the petitioner was driving the motor cycle rashly and negligently. Moreover, the petitioner was known to drive his motor cycle in the area rashly and negligently and was told on previous occasion not to do so. Despite the same, the petitioner continued to drive rashly and negligently.

In such circumstances, considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1890 of 2023 is dismissed.
