Mahapatra .....For the Petitioner After some argument the learned advocate for the petitioner prays that a direction be passed upon the learned Civil Judge (Senior Division), Basirhat, North 24 Parganas to dispose of the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure in Money Suit No.7 of 2024.

The learned advocate appearing for the petitioner submits that the written objection to the application under Order 39 Rule 1 and 2 has already been filed. He submits that the injunction application is otherwise ready for hearing.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application, along with a copy of this order, upon the opposite party or his learned advocates representing him before the learned Trial Judge.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 1689 of 2025 is disposed of by requesting the learned Civil Judge (Senior Division), Basirhat, North 24 Parganas to take up the hearing of the injunction application on the next date fixed, if the same is otherwise ready for hearing and dispose of the same as expeditiously as possible , without granting any unnecessary adjournment to either of the parties. With the above direction CO 1689 of 2025 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously after completion of all necessary formalities.
