APP Mr. Saswata Chatterjee ...for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. The Sessions Court had granted anticipatory bail to a person who is similarly circumstanced.

Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the injury reports, which show infliction of serious injury on vital part of the body like the head. Another person was assaulted. He suffered cut injury on chin and forehead. As per the statements of the witnesses present at pages 25 and 26 of the case diary, it was the present petitioner who was the principal assailant. He assaulted the victims with bricks. The petitioner clearly does not stand on the same footing as the other accused who was granted anticipatory bail by the Sessions Court.

Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
