But as the proceeding has been stayed by the High Court it is submitted that the investigation could not be proceeded with.
It appears from the order dated 19.12.2023 that the learned counsel for the State was directed to submit an explanation of a senior police officer in the present case "explaining why in a case under Sections 406/409 of the IPC, no document relating to money trail has been relied upon by the investigating agency".
No such explanation has been placed before the Court even today.
It prima facie appears from the report that the investigating agency subsequent to the order dated 19.12.2023 is trying to fill up the lacuna in the present proceeding and investigation, as it appears from the report dated 24.01.2024. Considering the said fact, the State is directed to submit a report, by 27.01.2025 other than the prayer for further
investigation, in compliance to the order dated 19.12.2023 passed by a Coordinate Bench of this Court.
Let the matter appear on 27.01.2025 for hearing. (Shampa Dutt (Paul), J.)
