Learned advocate appearing for the petitioner submits that the police are inactive despite several complaints. There is a subsisting order of status quo passed by the civil Court.

Learned advocate appearing for the State on the basis of written instructions dated July 22, 2021 submits that all the complaints were inquired into. The complaints resulted in a prosecution under Section 107 of the Criminal Procedure Code being submitted pursuant to order passed by the Additional Chief Judicial Magistrate. The police registered a complaint of the petitioner as a First Information Report and on completion of the investigation with regard thereto, a charge sheet was submitted.

There exists a civil dispute between private parties. Such disputes are subject matter of the civil suit. So far as the complaints of the police are concerned, it appears that the police took steps as were required as noted above.

In the circumstances, no further interference is called for by the writ court. The private parties are at liberty to avail of their remedies from the appropriate forum in accordance with law.

WPA 11372 of 2021 is disposed of accordingly.
