The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The defendants in a suit for partition are the petitioners of the instant application under Article 227 of the Constitution of India.

The petitioners, being aggrieved by an order of injunction passed in the suit, have preferred the Miscellaneous Appeal No.129 of 2023, which is pending before the Court of learned District Judge, District-Paschim Medinipur.

The petitioners are complaining delay in disposal of the said appeal and are praying a direction for expeditious disposal of it.

In view of the nature of order under challenge, the said appeal is required to be disposed of expeditiously, the appeal Court below, therefore is requested to dispose it of as expeditiously as possible in accordance with law, if it is otherwise ready for such disposal and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment.

CO 1482 of 2024 is disposed of with the above terms without any order as to costs.
