APP Mr. Ramashis Mukherjee ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is the helper of the truck, who has been implicated in connection with the instant case. Learned advocate again submits that three of the witnesses who have been examined in support of the prosecution's case do not inspire any confidence for establishing the foundational facts of the prosecution.

Learned advocate for the State opposes the prayer for bail and submits that there has been alleged recovery of about 150 kg of ganja in the present case. According to the learned advocate, it is the driver and the helper who have been charge-sheeted in the present case. The prosecution

has relied upon 13 witnesses and 10 more witnesses are yet to be examined.

Having considered the stage of the case, the prosecution is granted six months more time to complete the prosecution witnesses. In case, inspite of cooperation extended by the accused person, the evidence of the 10 witnesses is not complete within the next six months, the learned trial court would leniently consider the prayer for bail of the petitioner, if any application for bail is preferred by the petitioner.

At this stage, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

The learned Registrar General, High Court, Calcutta would communicate this order to the learned Special Court, under NDPS Act, Berhampore, Murshidabad.

Accordingly, CRM (NDPS) of is dismissed.
