Re: CAN 1 of 2023 This is an application for restoration.

Having considered the averments made in paragraph 25 of the restoration application, I am of the view that the petitioner has sufficiently explained the reason for his non-appearance before this Court on June 27, 2023.

Accordingly, the order dated June 27, 2023 is recalled and the writ petition is restored to its original file and number.

CAN 1 of 2023 is allowed.

WPA 10707 of 2023 By filing this writ petition, the petitioner prays for extension of time to submit research paper following the fellowship granted him by a memo dated October 08, 2012.

The initial fellowship was for a period of four years. The petitioner could not submit research paper within the stipulated period.

Thereafter, again the period of fellowship was extended by a further period of two years by the ViceChancellor of Rabindra Bharati University by a memo dated June 29, 2016.

It appears that the petitioner again could not submit his thesis paper within the extended period. The petitioner, in my view, is not entitled to any further extension.

In fact, the prayer of the petitioner was rejected by a Coordinate Bench of this Court by an order dated February 14, 2020 passed in W.P. No. 14346 (W) of 2018 (Ashutosh Mallick vs. Union of India & Ors.). In view of the above facts, the writ petition is not entertained.

Accordingly, WPA 10707 of 2023 is dismissed.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
