1. Mr. Moitra, learned Senior Advocate appearing on behalf of the appellant submits on instructions that his client wishes to withdraw the instant appeal and the applications with liberty to file afresh on the selfsame cause of action before the appropriate forum. 2.

With liberty reserved to the appellant as prayed for, M.A.T. 706 of 2025 shall stand dismissed as withdrawn.

3. In view of dismissal of the appeal itself, all the pending connected applications are dismissed.

4. Interim order, if any, shall stand vacated.

5. There will be no order as to costs.
