AD 54 May 20, 2025 Ct. 28 SG CRM(A) 1624 of 2025 Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak P.S. Case No.1508 of 2024 dated 22.09.2024 under Sections 126(2)/115(2)/117(2)/118(2)/109/74/3(5) of the BNS.

And In the matter of:

Sentu Sk. @ Sentu Sekh ... petitioner Mr. Kalidas Saha Ms. Khushi Mollick ... for the petitioner Ms. Baishali Basu Mr. Raju Jana ... for the State In view of the fact that the petitioner is substantially similarly circumstanced as Kuddus Sekh and Ebrahim Sk., who were granted anticipatory bail by a Division Bench of this Court on 13.01.2025 in CRM(A) 110 of 2025 and on 28.02.2025 in CRM(A) 707 of 2025, I am inclined to grant anticipatory bail to the present petitioner on the ground of parity.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and

on the further conditions that the petitioner shall attend the jurisdictional court on the dates fixed, shall surrender before the jurisdictional court and pray for regular bail within four weeks from this date and shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, allowed. (Jay Sengupta, J.)
