Having regard to the nature of the allegations for which the investigation commenced and charge-sheet was submitted before the jurisdictional court, generally, this court would not have interfered to terminate the

proceedings. But, as prayed for jointly by both the parties and having regard to the fact that the statement of the lady reflects that the petitioner and the o.p. no.2 is a married couple and they are peacefully leading a conjugal life, I am of the view that for the larger interest of the society, the continuation of the present proceedings may be an impediment.

Accordingly, for the ends of justice, I am inclined to quash the further proceedings of Shibpur P.S. Case No. 222 of dated 14.7.2022 under Sections 417/313/323/376/506/307 including the charge-sheet submitted therein.

With the aforesaid observations, CRR 1630 of 2023 along with CRAN 1 of 2023 is allowed.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
