Kausik (Rejected) CRM (NDPS) 1015 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chakulia Police Station Case No. 424 of 2025 dated 29.10.2025 under Sections 21(c)/25/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 7 and half months and has been implicated on the basis of alleged recovery of 618 Gms. of Brown Sugar. Prosecution, till date, could not commence the witness action and has relied upon number of witnesses in order to prove its case. Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been recovered in the present case.

Having considered the rigors of Section 37 of the NDPS Act being attracted, in the present case, at this stage, without

granting opportunity to the prosecution to adduce the evidence, I am not inclined to release the petitioner on bail. As such, prayer for bail of the petitioner in CRM (NDPS) 1015 of 2026 is rejected.

However, the learned Trial Court would expedite the process of trial and ensure the same is taken to its logical conclusion within a reasonable period of time. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
