The petitioner alleges certain illegal actions on the part of the Apartment Owners' Association. A complaint was lodged before the competent authority under the West Bengal Apartment Ownership Act, 1972 in April 2025. Alleging inaction on the part of the competent authority, the instant writ petition has been filed.

Learned counsel representing the competent authority submits, upon instructions, that the complaint of the petitioner has already been acted upon and that steps are being taken to consider and dispose of the same.

As it appears that the subject complaint is under active consideration of the competent authority, accordingly, the instant writ petition is disposed of by directing the second respondent to take steps in the matter strictly in accordance with law at the earliest and dispose of the same, after giving an opportunity of hearing to the parties to

defend their case, within a period of ninety days from the date of communication of this order. 4.

All documents in connection with the instant dispute shall be circulated to the parties so that everybody has a fair chance of representation before the concerned authority.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

6.

Certified copy of this order, if applied for, shall be made available to the parties.
