Leave is granted to the learned advocate for the petitioner to amend the cause title.
Mr. Chakraborty, learned advocate for the petitioner is aggrieved by the warrant of arrest issued by the Municipal Magistrate, 2nd Court, Calcutta in connection with Case No. 3017/2016. The learned advocate undertakes that the petitioner will abide by any condition so imposed for progress of the trial of the case.
Mr. Tanmay Kumar Ghosh, learned advocate, who ordinarily appears for the State, is directed to appear in this matter and represent the State. His appointment may be regularized by the concerned authorities.
In view of the undertaking given by the learned advocate appearing for the petitioner, I direct that in case, the petitioner surrenders before the learned Magistrate by 30.06.2022 and furnishes a bond of Rs.10,000/-, the learned Magistrate will release the petitioner on bail on condition that
the petitioner shall once in a month, whether any date has been fixed by the learned Magistrate or not, appear and obtain an acknowledgement from the office of the learned Municipal Magistrate, 2nd Court, Calcutta till further orders. In case, there is any violation, the learned Magistrate would be entitled to cancel the bond which has been furnished.
Execution of warrant of arrest so issued be stayed till 01.07.2022. In case, the petitioner does not surrender by 30.06.2022, the learned Magistrate would be at liberty to issue harsher process of law on and from 02.07.2022. With the aforesaid observations, the revisional application being CRR 1898 of 2022 is disposed of. Interim order, if any, is hereby vacated.
All pending connected applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
