Mr. Dilip Kumar Sadhu ........for the petitioner Mr. Ratul Biswas Mr. Jahangir Badsa ........for the State 1) Mr. Biswas, learned advocate representing State respondents has placed a copy of memo dated 26th May, 2025 issued by the Officer on Special Duty, Pension, Provident Fund and Group Insurance, Government of West Bengal addressed to the District Inspector of Schools (Primary Education), Purba Medinipur. Same is taken on record.

2) On perusal of objections raised in said memo dated 26th May, 2025, it appears that those objections are not relevant in sanctioning family pension in favour of the petitioner being widowed daughter due to death of her father on 8th June, 2023.

3) With regard to objections raised in said memo dated 26th May, 2025, it is submitted on behalf of the petitioner that already she has submitted income certificate issued by the Collector of Kolkata dated 27th January, 2025 certifying that monthly income of the petitioner is Rs. 2500/-. Therefore, according to the petitioner, she is entitled to get family pension.

4) Moreover, nothing is shown on behalf of State respondents that after death of father of the petitioner on 8th June, 2023 pension is being disbursed in favour of the deceased teacher.

5) Therefore, it transpires that there is no impediment in sanctioning family pension in favour of the petitioner.

6) The Director of Pension, Provident Fund and Group Insurance being respondent no. 2 is directed to issue Pension Payment Order in favour of the petitioner on completion of necessary formalities by fortnight from date of communication of this order. After issuance of such Pension Payment Order concerned State respondents are directed to release family pension in favour of the petitioner by four weeks thereafter.

7) Writ petition stands disposed of.

8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
