In the facts of the present case, the petitioner seeks a permission to repair the immovable property which is the subject matter of the civil suit.

In such circumstances, since the civil suit is pending between the private parties, no further interference is called for by the writ court. WPA 11453 of 2021 is dismissed without any order as to costs.
