Learned Counsel for the respondent nos. 9 and 10 upon instruction stated that as on date no excavation is going on the water body/area in question. The same is the stand taken by the respondent no.13 based on the local Police report. 3.

Heard finally, Mr. Das, learned Counsel appearing on behalf of the petitioner, Ms. Shaw, learned Senior Counsel appearing on behalf of the State respondents as well as Mr. Chakraborty, learned Counsel appearing on behalf of the respondent no.11.

During the course of hearing, learned Counsel for the parties arrived at a consensus. It is agreed that this Public Interest Litigation (in short 'PIL') may be disposed of by directing the respondent no.9 to consider the representation of the petitioner dated 4th April, 2025 to hear both the parties and pass a reasoned order thereafter within a stipulated period of time.

In view of the consensus arrived at, the PIL is disposed of by directing the respondent no.9 to fix a date for hearing both the parties on the complaint of the petitioner dated 4th April, 2025. After hearing both the parties, the concerned Block Development Officer shall decide the complaint by passing a reasoned and speaking order within thirty days from date. The outcome shall be communicated to the concerned parties. 7.
