(Through Video Conference) Mr. Jaharlal De Mr. Shamim Ul Bari ... ... for the State In the present petition the allegation has been made by the petitioner that the private respondent has constructed boundary wall on the Panchayet Road by encroaching upon the said road.
One of the prayer made in the petition is to command the respondents to consider and decide the representation dated 16.11.2015 within a time bound period.
Learned counsel for the State has pointed out that the representation is addressed to the respondent no. 5 and the same can be decided within a time bound period. The writ petition is pending since 2016 and no one is present today on behalf of the petitioner. It would be a futile exercise to keep the matter pending for indefinite period.
In the above circumstances, we dispose of this writ petition directing the respondent no. 5 to decide the pending representation dated 16.11.2015 in accordance with law expeditiously.
Needless to say, if required, the respondent no. 5 will give due opportunity of hearing to the petitioner as
well as the private respondent while deciding the representation.
