Mr. Nilankan Banerjee ....for the Petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division) 6th Additional Court at Alipore to dispose of the Title Suit No. 285 of 2019 expeditiously. In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned Trial Judge.

From the order sheet appended in this application this Court finds that 5th June, 2025 has been fixed for hearing of the injunction application and for police help.

In the light of the submissions made by learned advocate for the petitioner, CO 1691 of 2025 stands disposed by requesting the Civil Judge (Junior Division) 6th Additional Court at Alipore to take up the

hearing of the injunction application on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. The learned Trial Judge further requested to make an endeavour to dispose of the application for police help, if the same is otherwise ready for hearing as expeditiously as possible without granting any unnecessary adjournments to either of the parties. The learned Trial Judge is free to decide which of the application shall be taken up first.

There shall be however no order as to costs.
