Report submitted by the learned advocate appearing for the State be kept with the record. The petitioner approached this Court being aggrieved by the inaction of the police authorities that the representation advanced to the Officer-inCharge, Domjur Police Station was not acted upon. Petitioner is aggrieved in respect of the act and action of the police authorities as construction was being progressed by forceful and illegal means without obtaining no objection from the fire brigade department.

State has submitted a report which reflects that a Title Suit No. 644 of 2023 is pending against the present petitioner. The police authorities are well aware regarding the dispute over the construction. At the relevant point of time, police authorities also kept strict vigil so that no untoward incident resulted.

Having considered that the police authorities are well aware in respect of nature of the dispute

amongst the petitioner and the private respondent, I am of the opinion that in case any of the parties are faced with fresh inconveniences, they would approach the police authorities who would act strictly in accordance with law.

With the aforesaid observations, the writ petition being WPA 11603 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
