Learned advocate appearing for the petitioner 07.07.2025 Court No. 35 M/L. No.9 Rakib submits that the bank approached this Court as pursuant to the possession having been taken and unknown persons having shattered the padlock entered the said property which was notionally in possession of the petitioner/bank. To that effect a case being Tala Police Station Case no. 83 dated 19.12.2023 was registered for investigation but the grievance of the petitioner is that there was no progress in the investigation.

Records reflect that a notice under Section 94 of the BNSS was served upon the Chief Manager, Sastra Department, Punjab National Bank for production of the documents relating to the possession of the bank. In case, the bank authorities are able to produce the relevant documents relating to the notional possession of the bank, in that case police authorities would act and implement under the provisions of

SARFAESI Act, 2002 ensuring that the bank is not deprived of its right under the law.

With the aforesaid observations WPA 10673 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
