22.08.2022 S/L No.6 KS C.R.M. (SB) 117 of 2022 With IA No. CRAN 1 of 2022 Miraj Ali Molla -Vs.- The State of West Bengal In Re. An application for modification of the order dated 13.06.2022. Mr. Sabyasachi Mukherjee Mr. Arka Chakraborty Mr. N. Ahmed ..... For the Petitioner Mr. Soumik Ganguly .....For the State Report submitted by Mr. Soumik Ganguly, learned advocate for the State be kept with the record.

The prayer in the present application is to the limited extent of allowing the petitioner to enter in the jurisdiction of Rabindra Nagar Police Station which is the permanent abode of the present petitioner. I find that in the earlier order dated 13.06.2022 a Co-ordinate Bench of this Court was pleased to impose conditions restricting the petitioner from entering both Eco Park Police Station as well as Rabindra Nagar Police Station. The investigation of the case and the foundation of the offence relates to Eco Park Police Station. It has been submitted that the investigation has been concluded and the case has been committed to the Court of sessions. Having regard to the same, I am of the opinion that the earlier conditions imposed by the Co-ordinate Bench of this Court on 13.06.2022 is modified to the extent that the petitioner may be allowed to enter the jurisdiction of Rabindra Nagar Police Station. So far as the condition

relating to the petitioner being restrained from entering Eco Park Police Station, the same remains unaltered. Further it is directed that if the Learned Trial Court or the Court in seisin of Eco Park Police Station Case No.41 of 2022 dated 24.02.2022 thinks it fit and proper, the said Court would be at liberty to impose conditions as it deems fit and necessary, for progress of the trial in case there are non-cooperation from the present petitioner.

With the aforesaid observations, IA No. CRAN 1 of 2022 is disposed of.
