The petitioners contend that respondent nos. 10 and 11 have undertaken unauthorized construction on L.R. Dag No. 1355, L.R. Khatian Nos. 1108 to 1112, Mouza Ramdevpore, Police Station Daspur, District Paschim Medinipur. The petitioners assert ownership of the said land and allege that such construction amounts to encroachment upon their property.

It is further submitted that, during the pendency of the writ petition, the concerned Revenue Officer submitted a report before the Block Land and Land Reforms Officer, which appears at page 5 of the supplementary affidavit filed today by the petitioners. In view of the above, I am not inclined to keep this writ petition pending. It appears that the petitioners have submitted a representation before the Panchayat Authority by a letter dated January 2, 2024, which is annexed at page 49 of the writ petition.

The said representation shall be considered by the Pradhan of Rajnagar Gram Panchayat in accordance with law, after providing an opportunity of hearing to the petitioners as well as respondent nos. 10 and 11. Upon hearing the parties, the Pradhan shall pass an appropriate order in accordance with law.

This exercise shall be completed within a period of six weeks from the date of communication of this order.

Accordingly, WPA 11653 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
