AD 55 May 20, 2025 Ct. 28 SG CRM(A) 1625 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Domkal P.S. Case No.845 of 2024 dated 26.11.2024 under Sections 103(1)/3(5)/of the BNS.

Safikul Sk ... petitioner Mr. Jaydeep Biswas Mr. Amanul Islam Mr. Sourav Mukherjee Mr. Koushik Ghosh ... for the petitioner Mr. Bitasok Banerjee Mr. Arup Sarkar ... for the State Learned counsel appearing on behalf of the petitioner submits that two co-accused have been granted bail in this case. Charge-sheet has already been submitted. Upon instructions, it is submitted that the victim did not receive any injury.

Learned counsel for the State relies on the case diary, opposes the prayer for anticipatory bail and submits that according to the post-mortem report, the victim died by drowning. There are witnesses who had seen the petitioner and other co-accused take away the victim from his house. Later on, a witness saw the petitioner and others keeping the dead body on the bank of a pond and fleeing away.

Considering the nature of allegations and incriminating materials available in the case diary, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
