Mr. Chatterjee, learned advocate appearing for the petitioner submits that the petitioner was falsely implicated in two cases and in connection with the same two separate applications under Section 439 of the Code were preferred. In the first application being CRM 4653 of 2019, the petitioner was enlarged on bail by an order dated 4th June, 2019 on certain conditions. The second application preferred by the petitioner being CRM 4672 of 2019 was also disposed of by an identical order passed on 6th June, 2019. The condition incorporated in the said order dated 6th June, 2019 to the effect that 'the petitioner shall not leave the jurisdiction of Beliaghata Police Station', was waived by an order dated 16th August, 2019 passed in an earlier modification application being CRAN 2500 of 2019.

He further submits that similar condition to the effect that the petitioner shall not enter the jurisdiction of Newtown and Rajarhat Police Station until further orders was imposed upon the petitioner in the other bail application being CRM No.4653 of 2019. The said condition was waived by an order dated 18th December, 2020 passed in a modification application preferred by the petitioner. He, accordingly, prays for similar relief in the present application being CRAN 3 of 2020.
Mr. Mukherjee, learned public prosecutor appears on behalf of the State and files a report. Let the same be kept on record. Having heard the learned advocates appearing for the respective parties and considering the materials on record, we waive the condition as incorporated in the order dated 22nd November, 2019 to the effect that 'the petitioner shall not to enter the jurisdiction of Newtown and Rajarhat Police Station until further orders'. The other conditions of bail shall remain unaltered. With the above observations and directions, the application being CRAN 3 of 2020 is disposed of.
