No. 29 KAUSHIK REJECTED C.R.M.(A) 1892 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Harishchandrapur Police Station Case No. 509 of 2022 dated 24.06.2022 under Sections 341/324/325/308/34 of the Indian Penal Code.

And In Re : Md. Alamgir Hossain @ Alamgir Alam & Ors. ...... petitioners Mr. M. H. Chowdhury ....for the petitioners Mr. Arijit Ganguly Mr. Avik Ghatak ....for the State In an incident of assault, the victim suffered grievous hurt.

The victim was admitted to the ICU and underwent 'craniotomy' operation on the same night and was put on ventilation support. The victim was, thereafter, placed on 'T Piece' support.

Considering the gravity of the offence and the involvement of the petitioners in the incident of assault, we are unable to grant anticipatory bail to the petitioners.

Accordingly, prayer for anticipatory bail of the petitioners is rejected and the application being CRM (A) 1892 of 2023 is dismissed.
