The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The petitioner is the plaintiff of Ejectment Suit no. 169 of 2018, which is pending before the 2nd Court of learned Civil Judge (Junior Division), Alipore, District: 24-Parganas (South).

The petitioner is praying a direction for expeditious disposal of the said suit.

It appears from the record that applications under Sections 7(1) & 7(2) of the West Bengal Premises Tenancy Act, 1997 in the said suit are yet to be disposed of.

It is disturbing to note that to dispose of the applications of such nature, six years' time have been consumed, however, without any further delay, those applications are required to be disposed of expeditiously.

The learned Trial Judge therefore is requested to take steps to dispose of the said applications in accordance with law as expeditiously as possible, if the same is otherwise ready for such disposal, and thereafter shall make all endeavour to bring the Ejectment Suit no. 169 of 2018 to its logical conclusion within a reasonable time, and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 1492 of 2024 is thus disposed of without any order as to costs.

The petitioner shall communicate this order to the opposite party.
