Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocates appearing for the petitioner and the private respondents.

The petitioner has approached this Court since he intends to construct boundary wall which is being resisted by the private respondents. Petitioner prays for police protection.

On the other hand, learned advocate appearing for the private respondents submits that they are tenants and they are being attempted to be ousted.

I have considered the report submitted on behalf of the State which incorporates that a case was registered being Liluah P.S.

Case No.

172/2025 dated 02.04.2025 and charge-sheet has already been submitted. There are several cases

which are pending between the petitioner and the private respondents including the general diary entry. The concerned police station is well aware regarding the nature of the dispute existing between the petitioner and the private respondents. So far as the prayer which has been advanced by the petitioner that is not within the domain of this Court and is to be decided by the appropriate authority or the civil court. As such, the police authorities would only ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 10713 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
