1. Appellant is represented by the learned advocate.

2. Respondent no. 1/State is represented.

3. Nobody appears on behalf of the respondent/accused nos. 2 and 3.

4. In pursuance of the direction passed by this Court, the appellant/complainant, Kishor Kumar Hela, is present before this Court. Personal appearance of this appellant before this Court stands dispensed with.

5. It is submitted by the learned advocate for the appellant that the present appellant does not intend to proceed further with the present appeal.

6. The instant appeal is preferred at the behest of this appellant challenging the impugned judgment and order of

acquittal passed by the learned Judge, 1st Special Court, Burdwan in connection with Special Case No. 15 of 2012. As the appellant does not intend to proceed further with the present appeal, the present appeal should be disposed of on merit.

7. I have gone through the impugned judgment and order of acquittal passed by the learned Trial Court and I find nothing to interfere with the said impugned judgment and order.

8. Accordingly, the instant appeal be and the same is dismissed on merit affirming the judgment and order of acquittal passed by the learned Trial Court dated 20th January, 2015.

9. The report submitted by the S.I. of Police, In-Charge Kenda PP, P.S.- Jamuria, Dist.- Paschim Burdwan which is handed over by the learned advocate for the State during course of hearing be kept with the record.

10. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.

11. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
