The petitioners are aggrieved by the action on the part of DPSC Mushidabad in allowing 'A' category scale of pay to them on and from a later date but not from the next date of conclusion of the examination for obtaining training.

The petitioners completed the Diploma in Elementary Education Course from the National Institute of Open Schooling in the session 2017-2019 on 16th March, 2019.

It has been submitted that the 'A' category scale of pay ought to be allowed in their favour on and from the next date of conclusion of the examination and not from a later date.

Reliance has been placed on the order dated 19th July, 2024 passed by this Bench in WPA 16023 of 2024 (Dhiraj Kumar Singh & Ors. Vs. The State of West Bengal & Ors.) wherein the Court directed the respondent authority to grant 'A' category scale of pay to the petitioners after the last date of examination. In view of the above, the instant writ petition is disposed of by directing the respondent authorities to pay 'A' category scale of pay to the petitioners on and from the next date of conclusion of their training examination.

All arrears of the petitioners shall be positively disbursed within a period of eight weeks from the date of communication of this order.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
