Petitioner seeks anticipatory bail.

Learned Advocate appearing for the petitioner submits that the petitioner has been falsely implicated in this case. Some persons were arrested. Since police filed charge-sheet, custodial interrogation is not required.

Learned Advocate appearing for the State draws the attention of the Court to the dying declaration of the victim. Considering the dying declaration of the victim it transpires that the petitioner is one of the assailants and considering other materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

The application for anticipatory bail being C.R.M. 4678 of 2021 is, thus, rejected.
