...... petitioners Mr. Tushar Kanti Har Mr. Somnath Chakraborty ....for the petitioners Mr. Tanmoy Kumar Ghosh Ms. Sonali Bhar ....for the State CRM (A) 1893 of 2023 is dismissed as infructuous in respect of petitioner nos. 2 (Ganesh Kha @ Ganesh Khan) and 5 (Ramesh Mondal), as they stand arrested, as submitted in Court.

Case diary suggest that the remaining petitioners, namely, petitioner nos. 1 (Satyajit Dolai), 3 (Soumen Dolai) and 4 (Rajesh Khan), were involved in an incident of theft. They were identified by eye witnesses. Three motor cycles were seized. Considering the gravity of the offence and the involvement of the petitioner nos. 1, 3 and 4 in the incident of theft as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioners.

Accordingly, prayer for anticipatory bail of the petitioner nos. 1, 3 and 4 is rejected and the application being CRM (A) 1893 of 2023 is dismissed.
