The petitioner is the son of Achinta Kumar Maity, who was an employee of the United Bank of India, which has now merged with Punjab National Bank and is known by that name. The petitioner's father died in harness on 6th December, 2017. The petitioner is seeking compassionate appointment from Punjab National Bank. The petitioner has made an application in the requisite proforma on 8th June, 2020 but, according to the petitioner, the said
application has been kept pending by the respondent Punjab National Bank without taking any decision on the same.
After hearing the parties and considering the materials on record, I find justice will be subserved if the respondent no. 1 is directed to take a decision on the petitioner's application dated 8th June, 2020 following the existing policy of the respondent Punjab National Bank, if any, for providing compassionate appointment. The respondent no.1 shall pass a reasoned order stating the details of the policy of the compassionate appointment, if any, now prevailing in Punjab National Bank after affording the petitioner a reasonable opportunity of hearing following the prevailing COVID 19 protocol. The entire exercise for disposing of the petitioner's application dated 8th June, 2020 appearing at page 42 of the writ petition shall be completed within a period of eight weeks from date. In the event the respondent no.
1 finds that the petitioner is eligible for compassionate appointment in terms of the prevailing policy of Punjab National Bank, the respondent no.
appointment so that the petitioner's name can be recommended without any further act.
Since the respondent no.1 is already represented, no further notice shall be given to the respondent no.1. He shall act on the basis of a server copy of the instant order without insisting upon a certified copy thereof. However, by way of abundant caution, learned advocate appearing for the petitioner shall serve a copy of this order upon the respondent no.1 within seven days from date. Since no affidavit-in-opposition is called for, allegations contained in the writ petition are deemed to be denied.
Nothing further remains to be adjudicated in this writ petition. The same is accordingly disposed of without any order as to costs.
Urgent xerox certified copy of the order, if applied for, be given to the parties on usual undertakings.
