Petitioners are aggrieved by the fact that in spite of directions passed by the learned Civil Judge (Senior Division), Basirhat in Title Suit No.285 of 2025 directing the Inspector-in-Charge, Basirhat Police Station to implement the injunction order dated 26.03.2025 passed by the said court, there has been violations at the behest of the private respondents who had been continuing with the construction work in defiance of the court's order. Learned advocate for the private respondents denies and disputes the accusations so made and submits that there were no attempts even for violating the civil court's order.
State has submitted a report. Report reflects that the police authorities have enforced the civil court's order. The construction work has been stopped and police patrolling has been deployed. Police authorities on the basis of the information furnished by the present petitioner has also initiated Basirhat P.S. Case No.376 of 2025 dated 06.05.2025. Having regard to the steps taken by the police authorities, I direct that they would continue their surveillance and ensure that no untoward incident or infraction of the civil court's order takes place.
With the aforesaid observations, WPA 10607 of 2025 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
