State of West Bengal Mr. Sourav Mondal, Mr. Subhajit Chowdhury, Mr. Rony Mondal ...for the petitioner Petitioner herein is aggrieved with the inordinate delay caused in disposal of the G.R. Case No.3195 of 2015 under Sections 341/323/354/506/34 of the Indian Penal Code presently pending before learned Judicial Magistrate, 1st Court, Barrackpore. Learned Counsel for the petitioner submits that the FIR in connection with the said application was filed almost 11 years back on 7th June, 2015. Thereafter, charge sheet was submitted after completion of investigation on 30th September, 2015 and the charge was framed on 4th December, 2019. Since then, not a single witness could be examined and the prosecution proposes to examine six witnesses. He further submits that the accused persons in order to drag the proceeding have filed one application for appointment of Commissioner prior to 4th December, 2024 which also remains undisposed of. Accordingly, he prayed for necessary direction upon the Court below.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, for

expeditious disposal of the proceeding, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with.

Having considered the fact that the proceeding is kept pending for more than 11 years, I find that the prayer made by the petitioner is justified and required to be allowed for securing the ends of justice.

In view of above, the instant application being CRR 2017 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour to dispose of the pending application preferably on the next date or within a period of 30 days thereafter and to conclude the entire proceeding preferably within a period of six months therefrom.
