Banerjee) Mr. Arunava Ganguly ...for the petitioner By the order dated May 17, 2023, the learned Civil Judge (Jr. Division) 3rd Court of Serampore, Hooghly refused the prayer for ad interim injunction on an application under Order 39 rules 1 and 2 of the Civil Procedure Code filed in Title Suti No. 266 of 2023.

However, it appears that subsequently the learned trial judge by an order dated April 4, 2024 has allowed the application under Order 39 Rules 1 and 2 Civil Procedure Code in part.

Learned advocate appearing for the petitioner submits that the petitioner is not aggrieved by the subsequent order dated April 4, 2024 but is aggrieved against the order dated May 17, 2023.

The order dated May 17, 2023 is an appellable order in view of the provisions under Order 43 Rule 1(r) of the Civil Procedure Code.

In view thereof, this court is not inclined to entertain this application. Accordingly, CO 1698 of 2025 stands dismissed.
