The main prayers of the petitioner are that the property being the three flats situated on the first floor at premises no.

13, Mullan Road, P.S.- Ballygunge be handed over to the petitioner and the police authorities be also directed so that there is no encroachment by way of illegal parking of vehicles at the behest of the respondent nos. 5 to 7.

Learned advocate for the State submits that the police authorities cannot on a complaint take action under such circumstances.

Further, it has been pointed out that the Wakf Board is in seisin of the issues. Notices have been issued to the private respondents and/or other necessary parties.

Learned advocate for the private respondents enters appearance and disputes the accusations.

Since the Wakf Board is already in seisin of the issues, I direct that in case any direction/order is passed upon the police authorities in respect of the three flats situated on the first floor at premises no. 13, Mullan Road and/or relating to parking of the vehicles thereby encroaching the said property, the police authorities would respect, obey and implement the order passed by the Wakf

Board.

With the aforesaid observations, WPA 10724 of 2025 is disposed of.

Pending connected application(s), if any, is also disposed of.
