12.04.2023 Court No.35 Item No.

D.Hira CRA 214 of 2012 Swapan Kumar Ghosh Vs.

The State of West Bengal & Ors.

No one is appearing for any of the parties even after the matter is called on for the second time. This appeal is pertaining to the year 2012, it appears that since after 14.05.2012, no one has represented in this case.

The appeal being barred by limitation, the appellant was given liberty to prefer an application under Section 5 of the Limitation Act. No such application has ever been filed as yet. Since this is an old pending appeal of 2012 and the appellant is not represented, since after 2012 and also that no application to pray for condonation of delay in filing of this appeal is preferred, without wasting any further time, the same is taken up for disposal. After perusing the copy of the impugned judgment and the grounds pleaded by the appellant, no cogent reason is found as to why the impugned judgment should be interfered with by this Court, as the appellant has not been able to bring forth any sufficient and tangible grounds to challenge its legality and propriety. Otherwise also, this appeals is barred by limitation.

Thus, being devoid of merit, this appeal is dismissed. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
