Mookherjee Mr. Abhratosh Mazumdar Mr. Prasum Mukherjee Mr. Deepak Agarwal Mr. Subhrojyoti Mookherjee ...for Damodar Valley Corporation By filing this writ petition, the writ petitioners prayed, inter alia, for the following reliefs: "a) A writ of and/or order and/or direction in the nature of certiorari calling upon the respondent nos.1 to and to withdraw their communications dated 13th February, 2025, 20th April, 2025 and 7th May, 2025;

b) A writ of and/or order and/or direction in the nature of mandamus directing the respondent nos.1 to 5 and to immediately restore the electricity to the factory of the petitioner no.1, upon adjustment of 50% of its arrears for the year 20172018 from its security deposit and upon receipt of post-dated cheques with respect of the remaining 50% of the arrears."

It appears that disputes with regard to the outstanding dues from the petitioners have already been raised in MAT 762 of 2023 (M/s. Ispat Damodar

Private Limited & Anr. - vs. - Damodar Valley Corporation & Ors.) which is being considered along with some other appeals, by a Division Bench of this Court presided over by the Hon'ble Chief Justice. The Appeal Court has passed two interim orders on February 10, 2025, and April 8, 2025, providing certain modes of payment for the petitioners. The appeals, however, have not yet been disposed of. In that view of the pendency of the appeals, I am not inclined to entertain this writ petition. This shall not, however, preclude the petitioners for filing appropriate application before the Division Bench for redressal of their grievances.

Accordingly, WPA 10614 of 2025 is disposed of.
