The present writ petition has been preferred challenging an order dated 19th March, 2024 passed by the learned Tribunal in the original application being O.A. No.396 of 2024 (LRTT).

Mr. Das, learned advocate appearing for the petitioner submits that instead of disposing of the original application with a specific direction upon the respondent no.2 to consider and dispose of the pending statutory appeal, the learned Tribunal fixed the matter for further consideration about five months thereafter on 27th August, 2024.

Mr. Sen, learned advocate enters appearance on behalf of the respondent no.4 and submits that upon calling for a report from the respondent no. 2, the matter has been fixed for hearing on 27th August, 2024. There is,

thus, no infirmity in the order, warranting interference in the present writ petition.

Records reveal that the writ petitioner filed a statutory appeal before the respondent no.2 and the same was received by the respondent no.2 on 15th January, 2024. As the said statutory appeal was not disposed of, the petitioner preferred the original application alleging inaction against the respondents. Upon calling for a report from the respondent no.2 regarding the status of the statutory appeal, the learned Tribunal had fixed the matter under the heading 'Motion' on 27th August, 2024. This Court cannot issue directions for speedy disposal unless there is a justification or acceptable reason for issuing any such direction.

Considering the facts and circumstances of the case, we are not inclined to issue any direction upon the learned Tribunal towards expeditious disposal, as sought for in the present writ petition.

Accordingly the writ petition is dismissed.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties. (Partha Sarathi Chatterjee, J.) (Tapabrata Chakraborty, J.)
