Mr. Tarun Kumar Das Mr. Anindya Bose ..for the petitioner Mr. Pinaki Dhole Mr. Suman Dey ..for the State The contempt proceeding has been initiated on alleged violation of the order passed by a coordinate Bench on 8th March, 2019 on WP 22641 (W) of 2017. The contempt application was taken up for hearing by the coordinate Bench on 9th August, 2019 and the coordinate Bench directed the matter to go out of the list in view of the intra court appeal being preferred by the contemnors/respondents.

Today the contempt application has come up in the list for consideration when Mr. Tarun Kr. Das, learned Advocate appears on behalf of the applicant and submits that the order passed by the coordinate

Bench dated 8th March, 2019 has already been set aside by the Hon'ble Division Bench vide order dated 9th October, 2020 and the writ petition has been remanded to the learned single Judge for consideration afresh.

In view of the order passed by the Hon'ble Division Bench dated 9th October, 2020 on FMA 912 of 2020 the contempt proceeding is dropped.

Since the prayer has been made on behalf of the applicant/petitioner to include the writ petition for hearing and this Court, at present, is having the determination to take up the matter, list the writ petition under the heading "Hearing" on 3rd January, 2022.

CPAN No. 539 of 2019 is disposed of.
