Patra Mr. Kanak Kiran Bandyopadhyay ..... for the alleged contemnor The affidavits of compliance have been filed by the alleged contemnor which in Court today. The relevant document in the affidavits of compliance shows that the direction passed by this Court on 25th February, 2019 has been complied with to clarify, this Court had set aside the rejection of the petitioner and had directed the alleged contemnor to consider the petitioner for verification in the 1st phase of the applicable test. The Court had further observed that the petitioner shall be considered for the post applied for on the strength of its credentials as prescribed under the relevant Rule applicable for TET, 2015. The direction was to be carried out within a specific time frame.

It is submitted on behalf of the School Service Commission that the petitioner's qualification were found to be insufficient for the post applied for under the relevant Rule. This Court is however not willing to go into the question, since the direction so far as conducting the verification in the 1st phase of the petitioner has been complied with. Hence nothing further remains in the contempt proceedings. The prayer of the petitioner for filing an exception to the report is rejected on the aforesaid basis.

CPAN 540 of 2019 is disposed of in terms of the above order.
