Petitioner earlier approached this Court in WPA 7391 of 2025 when this Court after hearing both the parties was pleased to make observations in its order dated 21.04.2025 as follows :- "Learned advocate for the State has submitted a report. Report reflects that the same was a clerical error which was subsequently corrected by informing the jurisdictional court. Report also reflects that the typographical error was insertion in the list of witnesses, the name of one Sankar Ganguly, the father of the de facto complainant as CSW-2. However, the actual CSW-2 would be Sandip Ganguly. The same was brought to the notice of the learned ACJM, Alipore and necessary prayers were allowed by the concerned court.

Having considered that steps have been taken and amendments have taken place, petitioner at this stage do not make out any case for interference by this Court. However, if the petitioner is aggrieved, petitioner would take up all the issues canvassed in the present writ petition along with other necessary points before the learned jurisdictional criminal court at the time of consideration of charges."

In view of the earlier order subsequently spelling out that if the petitioner is aggrieved then all the issues should be canvassed by the petitioner before the learned Jurisdictional Criminal Court at the time of consideration of charges there has been no change in circumstances. Petitioner has again challenged the charge sheet which has been submitted taking up a plea that there has been a forgery committed by the investigating officer of the case. Since the same was dealt with in the earlier writ petition, I am of the opinion that the same plea cannot be entertained again. Consequently, no interference is called for.

State has submitted a report. Let the same be kept with the record.

Accordingly, WPA 10667 of is dismissed.
