Das, Mr. Sanjoy Mukherjee ....for the State The petitioner alleges unauthorised construction at premises no. 152/2, Salkia School Road, Police Station - Golabari, District Howrah, PIN - 711 101. Mr. Gupta, the learned advocate representing the petitioner, contends that two additional floors have been constructed without a sanctioned plan from the Howrah Municipal Corporation.

In contrast, Mr. Ganguly, the learned advocate representing respondents nos. 4 to 7, asserts that the construction was carried out strictly in accordance with the approved sanctioned plan and denies

unauthorised construction as alleged by the petitioner. The learned advocate for the Corporation, however, informs the Court that the Corporation is contemplating a joint inspection of the building, with due notice to both the petitioner and respondents nos. 4 to 7.

I direct that such an inspection be conducted within a period of four weeks from the date of this order. Following the inspection, the Corporation shall take appropriate action in accordance with the law. Accordingly, WPA 11668 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
