Learned advocate for the appellant fairly submits that in view of the recent judgment of this Court in the case of Panchanan Mahato -Versus- The State of West Bengal & Ors. in MAT No.44 of 2022, the points urged in this appeal do not survive and the appeal may be disposed of.

MAT 641 of 2021 is, accordingly, disposed of along with the connected application being I.A. CAN 1 of 2021.
