The petitioner is aggrieved by the fact that as the police authorities have failed to consider the representation which was advanced to the Officerin-Charge, Hemtabad Police Station dated 02.04.2025. Additionally it has been submitted that the limited grievance of the petitioner relates to measurement by a surveyor in respect of Plot No. 946/1939.

State has submitted a report which reflects that a long standing land dispute is existing between the petitioner and the private respondents. In view of the fact that a title suit being Title Suit No. 146/2023 (Nirod Chandra Das Vs. Belu Deb Sharma) is pending, if the petitioner is aggrieved regarding the inaction of the police authorities and claims that the subject-matter of the land is not before the civil court, in that case,

an application be taken out before the civil court which is in seisin of the issue. Learned civil court, if it passes necessary directions upon the police authorities, police authorities would respect, obey and implement such order.

In the meantime, the police authorities would ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 10668 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
