Today, learned advocate for the State has handed over a report of the concerned police station namely Panskura Police Station dated 6th September, 2021 wherefrom it appears that chargesheet against the petitioner has been filed in Panskura PS CS no. 227/21 dated 08.06.2021 under section 406/34 IPC. The report is kept on record.

Learned advocate for the school submits that they have come to learn about the present status of the case. On the last occasion this court directed the concerned District Inspector of Schools and also the Headmaster of the school to look into the matter so that

the provisional pension in terms of the DCRB scheme of 1981 as applicable to the petitioner can be released to him.

Today, the learned advocate for the petitioner has alleged that he has not received any provisional pension. I direct the District Inspector of Schools (S.E.), Purba Medinipur to take appropriate steps within a period of three months from date so that the process for payment of provisional pension can be started. The school is also directed to give full assistance to the concerned District Inspector of Schools in respect of processing the provisional pension to the petitioner. The petitioner has prayed for release of other amount of money after deducting the amount which has been allegedly defalcated by him.

Considering the facts and circumstances of the case, I reject such prayer.

With the above observation, this writ application is disposed of.
