APP Mr. Amal Kumar Datta ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case involves alleged recovery of 195 bottles of Eskuf cough syrup and the petitioner is in custody for about six months; charge-sheet has already been submitted and the prosecution has relied upon 11 witnesses in order to prove its case.

Mr. Gouranga Kumar Das, learned APP, appears on behalf of the State along with a junior of his choice as per the direction of this court. The appearance of both Mr. Das and the junior of his choice, if any, be regularized by the concerned authority.

Learned advocate for the State opposes the prayer for bail.

I have taken into account the period of detention of the present petitioner and the fact that some time will be consumed in taking the trial to its logical conclusion as 11 witnesses have been cited in the charge-sheet. Having regard to the same, I am inclined to release the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Biman Mandal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Malda without prior permission of the learned Special Court/trial court.

Accordingly, CRM (NDPS) 1024 of 2026 is allowed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
