Petitioner has approached this Court as according to him, the police authorities did not act on his complaint. Learned advocate for the petitioner has referred to page 26 of the writ petition which do not reflect any address by means of which the information was furnished with the police station. State has submitted a report. Report reflects that on 15.05.2025 the Officer-in-Charge of Kaliganj Police Station met with the petitioner and invited a written complaint. However, the petitioner submitted that he would file a fresh written complaint. Surprisingly, on 16.05.2025 as it is reflected from the report the petitioner came down to Kaliganj Police

Station and stated that he will not submit any fresh complaint as advised by his advocate. The same has been recorded by way of a General Diary Entry No. 575 dated 16.05.2025.

Having considered the approach of the petitioner, I direct that in case the petitioner is aggrieved, petitioner would approach the learned Magistrate under the relevant provisions of Section 175(3) of the BNSS. Learned Magistrate would, according to the provisions of law, deal with the same. With the aforesaid observations, WPA 10670 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
