The petitioner herein is aggrieved with the order dated 17th April, 2026 passed in Special T.R. Case No.103 of 2021, by which the Court below had issued warrant of arrest against the petitioner on the ground that the petitioner's petition seeking accommodation is not signed by recorded lawyer of the accused. However, petitioner herein has made a very innocuous prayer that liberty may be given to him so that he may surrender before the Court below.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. In view of above, the instant application being CRR 2067 of 2026 is hereby disposed of with a liberty to the petitioner to surrender before the Court below within a period of three weeks from this date and in the event of such surrender, the Court below

will dispose of his prayer in accordance with law without being influenced by any observation made herein.

The impugned order dated 17.04.2026 by which the warrant of arrest was issued against the petitioner shall remain stayed for a period of three weeks or till the petitioner surrenders before the Court below, whichever is earlier.
